I Levin Moore of the County and State aforesaid, do constitute and make this my last will and testament, being in bad health but sound mind. 1st. I give and bequeath unto my beloved wife Penelope Moore all my lands consisting of three hundred and ten acres whereon I now reside and all my horses consisting of three head and my other stock of cattle hogs and plantation tools, to have and enjoy to her use and benefit during her natural life. 2nd . At the death of my beloved wife Penelope Moore, it is my will that all the property, lands, stock of negroes, etc., be equally divided between my children (Ann M. McGinty, Malinda M. Moore, and Wiley P. Moore) with this exception that my beloved daughter Malinda Moore and Wiley P. Moore have one feather bed and furniture and forty dollars each more than my beloved daughter Ann M. McGinty making up equal to an amount I advanced to Ann M. McGinty at the time of her marriage. 3rd. In conclusion, I hereby appoint my beloved wife Penelope Moore and Benjamin F. Moore my Executors of this my last will and testament no bond required. 4th. And I hereby empower them my Executors my beloved wife Penelope Moore & B. F. Moore with privilege to sell at any time any portion of the property for the benefit of the Family. 5th. That my Executor B. F. Moore, in whom I have the greatest confidence, should survive my beloved wife Penelope Moore, he shall use his own discretion in making the decision whether it is best to divide the land, negroes and all other effects or to sell the same. 6th. In regard to the portion I give and bequeath unto my beloved daughter Ann M. McGinty, it is given Expressly for the use benefit and Enjoyment of her and her lawful heirs. 7th. And I hereby appoint Benjamin F. Moore her trustee to manage the same for the use of her and her heirs to best of his skill and ability.
