The draft law passed in April 1862 required service of men ages 18 to 35. You might find him on the rolls of Butler County militia companies, which accepted younger teens and men up to age sixty as well as exempts. There are several Hearns in Company "K", 1st Alabama Regiment. These are George W., J. C. and Elijah Hearn. However, that company was from Autauga County. There is an abundance on this regiment, including a history of Company "K". This regiment operated heavy artillery at Pensacola, Island Ten, Port Hudson and Mobile, from 1861 to 1864. Some of the best known photographs made of Confederate troops during the war were made of this regiment at Pensacola in 1861. The Edwards photos often show officers and men manning their artillery pieces, pointed across the bay at Fort Pickens. There were a couple of other possibilities, such as Joseph M. Hern of Co. "F", 9th Alabama Regiment, but he's from Athens AL. I also checked J. M. Horn of Co. "E", 15th Alabama Partisan Rangers. That company was recruited in Butler County, but his first name is James. The ADAH in Montgomery has rolls of County Reserves, AKA 1st Class Militia. I'll bet he's on one of them. He may be listed among the governor's papers of men who applied for an exemption from service. There's a file for each Alabama county -- all 52 -- for requests and petitions made to the war-time governors on this subject.
